When you are buying land or house and the seller says “relax, my Lawyer will take care of everything” many buyers feel relieved. Big mistake.
A Lawyer engaged by the seller does not represent you, no matter how polite or reassuring he sounds. A Lawyer owes loyalty to only the person who hired and pays him. That is who’s interest he must protect.
So when you hear that one Lawyer is handling both sides what plays out is: the seller’s interest takes priority; the Lawyer’s main goal is to help the seller complete the sale, receive payment and close the deal fast.
They may not disclose that the land is disputed, consent is absent, ownership is shaky, another party has a claim or that the property falls under Government interest.
If things collapse after the purchase, that Lawyer will not defend you. He cannot question or attack a transaction he helped the seller conclude.
You will be on your own. That is why relying on the seller’s Lawyer is risky.
Without your own Lawyer, nobody is reviewing documents with your protection in mind or asking tough questions for your benefit.
Nobody is advising you to slow down, negotiate or walk away. When problems later surface, multiple ownership claims, court battles, demolished buildings or other disputes, saying “the seller’s Lawyer handled it” will not save you.
Hiring your own Lawyer is good judgment. Not having your own lawyer is merely hoping for the best.
Remember, hope is not a legal plan.
