A property mistake can cost you more than the purchase price.

It can cost you the land/building, your hard-earned money and legal battles.

Many people enter property transactions in Nigeria believing that trust, familiarity, recommendation or impressive-looking documents are enough to keep them safe.

Buying property in Nigeria can be like entering a jungle. Fraud does not announce itself. It often comes with convincing stories, friendly smiling faces and documents that appear genuine.

A seller may have documents but have no legal right to sell. A land/building may be affected by dispute, Government acquisition, court cases, mortgages or competing ownership claims, yet these problems will be visible to an unsuspecting buyer.

So legal due diligence (investigation) is important. It is investigating the property, seller and the ownership history before paying.

It helps uncover unseen risks that could cause you losses.

Many buyers only consult a Lawyer after a problem arises. By then irreversible damage may have been done.

Prevention is mostly far less expensive than correction.

BE CAREFUL WHEN BUYING LAND/BUILDING IN NIGERIA

In Nigeria, many people rush land/building buying transactions because they are afraid of “losing the opportunity.”

The seller and agent say other buyers are waiting, creating pressure, emotions take over and payment is made quickly.

Then the problems begin.

The land is under dispute, ownership documents are defective. The property is having Government acquisition issues and another person appears claiming ownership.

The same land has been sold to many people. Suddenly, the “good deal” is a bad deal. Real estate does not reward impatience; it punishes it.

By the time many buyers know it, they have already paid money into a compromised transaction.

So you need a Property/Real Estate Lawyer before you pay.

It’s not just about inspecting the land physically.

Get a Property Lawyer to do proper legal due diligence, including verifying ownership, checking ownership documents, investigating issues, checking Government records, confirming survey, identifying risks and if the seller has lawful authority to sell.

Too many land/building buyers skip these steps because they want to move fast. That shortcut has become one of the most expensive mistakes in real estate.

Many Nigerians in the diaspora have lost property investments by trusting half information and rushing transactions.

Slow down. The land will not run away. Buy land/house the right way.

Many land buyers in Nigeria believe payment completes ownership. It does not.

A land purchase agreement can look professional, signed, contain survey details and still not protect the buyer.

A well drafted Declaration of Ownership clause is not decorative legal language.

It is a legal protection mechanism that helps establish the seller’s authority to transfer ownership, confirms the buyer’s ownership rights over the property, strengthens undisturbed possession and reduces future disputes capable of threatening your money, land and structures/developments on it.

Without strong ownership declarations, a buyer can land in ugly legal battles he never imagined.

You can build on land for years and still face serious ownership issues because the transaction documents were weak, vague, incomplete or poorly drafted.

Too many people focus only on price negotiation and ignore the legal architecture of the transaction. Big mistake.

Property documents should not be treated like ordinary paperwork. Every clause matters. Every word carries legal consequences.

One poorly drafted provision can weaken ownership protection and expose the buyer to avoidable risks.

The signatures were complete and the parties were happy.

Everybody believed the deal was secure.
Then the court said the Memorandum of Understanding meant nothing.

An MoU is not a legally enforceable contract just because it was typed, signed or stamped.

If it does not clearly show an intention to create binding legal duties, define enforceable duties and contain well structured terms, it will fail.

Many people treat MoU’s casually. They download samples online, copy documents from others or draft vague agreements filled with promises and emotional language.

Everything looks fine until one party defaults, denies responsibility, withdraws from the deal. Then the weakness of the document becomes obvious.

A poorly drafted MoU can leave parties without legal remedies, enforceable rights and protection after substantial commitments have been made.

Negotiation, planning, payments or development efforts can become difficult to recover.

Transactions require good legal drafting. An MoU should state obligations, timelines, commitments, default consequences, dispute resolution mechanisms, ownership structure and the intention of the parties to be legally bound.

Whether you are in Nigeria or abroad, never assume that a signed Agreement automatically protects you. In law, wording, structure and legal intention matter.

Many transactions fail because the transaction document was legally weak from the start.
