WHEN BUYING LAND/BUILDING IN NIGERIA, CONDUCT LAND REGISTRY SEARCH
When you want to buy land/house in Nigeria, get a Lawyer in Nigeria to do a search at the lands registry to know its current status.
Registration of land at the lands registry is endorsed on the ownership document.
If the land is registered, it may reveal if there is any form of legal issue like sale, mortgage, mortgage, caveat, etc.
Such legal issues would ordinarily be recorded in the details of the land at the lands registry.
There are consequences of transacting in a land/building affected by legal issues.
The proper thing to do would be to discontinue the buying.
This search is a fact-finding mission, and facts received from the search should guide your decision and proper steps taken to avoid getting hurt.
Where there is a legal issue affecting the land, that is a red flag and the buyer has a duty to proceed with caution.
In most cases sales, mortgages, transfers, pledges, caveats, etc are not usually registered in the land registry even when previous transactions over that land are registered in the land registry.
Have it at the back of your mind that there may be some other transactions over the land that were not registered in the land registry and that surely counts.
So the outcome of a search at the land registry does not end the search for the current ownership or legal status of the land/house.
