A Power of Attorney is a written authority to act for another person.
There are circumstances where the owner is unavailable or unable to transact in person with the buyer.
It could be due to distance barrier (maybe he is abroad), age or health issues.
Land/house can be sold by the owner’s representative where the owner signs a proper Power of Attorney giving the power to sell to another person.
Demand to see a Power of Attorney from the land/building owner in favour of the representative.
When you are shown a Power of Attorney, verify its authenticity by reaching out to the owner.
With due diligence (investigation) by a trusted Lawyer, you will know if the owner is genuine.
Proper findings will point you to the real owner.
While confirming the genuineness of the seller and the Power of Attorney, the Lawyer will scrutinize every detail in the Power of Attorney and ensure that it grants that representative powers to sell the land or house.
Check the identity of the land. Pay close attention to details. Be sure that the Power of Attorney is duly signed by the seller, then signed and stamped by a Notary Public (notarized).
It is only when you have verified the identity of the owner and that the Power of Attorney is not fake that you should consider proceeding with buying the land/house.
