HOW TO CORRECT MISTAKES IN PROPERTY/LAND/BUILDING AND BUSINESS AGREEMENTS
When people discover a mistake in a property/land/building or business document, their first instinct is to grab a pen, cancel the error and write the correct information.
Others use correction fluid or make handwritten changes in the margins. What looks like a simple solution can create a serious legal problem.
A legal document must clearly show what the parties agreed to. Once alterations appear on the face of the document, questions immediately arise.
Who made the change? When was it made? Did all parties agree to it? Those questions can trigger avoidable disputes.
An error in a buyer’s name, property description, purchase price, survey details or business terms may seem minor today but could become a major issue years later when ownership is challenged, the property is sold or the document is presented for registration.
The safe approach is not to amend the document with a pen or correction fluid. You will need a well drafted supplementary Agreement, addition, rectification Agreement or a fresh Agreement.
A poorly corrected document can badly affect you and expose you to unnecessary legal challenges. You do not want that. Do you?
