WHAT DOCUMENT TO PREPARE WHEN YOU BUY A LAND/BUILDING WITH C OF O
Buying land or building with a Certificate of Occupancy (C of O) and thinking the sealed is done? That confidence can be dangerously premature.
In Nigeria, a C of O does not automatically make you the recognized new owner of land after paying.
The law requires a Property/Real Estate Lawyer to prepare and register a Deed of Assignment in your name.
This document is what legally transfers ownership from the seller to you and formally replaces the seller’s name with yours.
Without a properly drafted and registered Deed of Assignment, you may pay in full yet remain a legal stranger to the land.
You cannot confidently prove ownership, you risk challenges from third parties and your future transactions involving the property can collapse.
The Deed of Assignment is the legal bridge between payment and lawful ownership.
This is why a Property Lawyer must be engaged early enough in the buying process, not after you have paid money.
Early legal involvement ensures due diligence (search and investigation) is conducted by a Property Lawyer, the C of O is verified, the transaction is properly documented and the Deed of Assignment is registered in compliance with the law.
Whether you are in Nigeria or living abroad, cutting corners at this stage can cost you the entire investment.
So ensure your purchase is not just paid for but legally perfected.
In property matters, possession is not ownership.
