Did you know that there is a law in Nigeria property law called the limitation of action law.
It states when you can lose your land/building no matter how strong your claim is.
In simple terms, limitation law means there is a deadline for taking legal action.
Once that time passes, you lose the right to sue, even if you are rightful owner. Even the court will tell you that you came late and it can not help you.
When it comes to land matters in Nigeria, the limitation period is usually 12 years.
This means if someone takes over your land or building or trespasses on it and you do nothing for 12 years, you may lose your right to reclaim it.
This law does not care how you struggled to buy the land. It does not care if your documents are perfect.
If you “sleep on your rights,” the law says: you are out of time. It is what it is.
But there are exceptions like if fraud or mistake was involved, the time may not start counting until you discover it.
If the person is in possession with your permission (e.g. a tenant), time starts counting only after that permission ends.
So you see, waiting too long is dangerous as you could lose your land and money.
But taking action early enough protects your property rights and helps you get justice while the court still has power to help you.
Delay is deadly in land matters.
So act fast.
